Actually, that is how our legal system works.  Our system is based off of
English Common law which is itself derived from Anglo-Saxon Common law
(Let's hear it for the heathens!!! hehehe).  It's are legal systems based on
precedence rather than codified law (in contrast, look at Napoleonic
code...Louisiana's legal system is based on Napoleonic code...if you have
ever lived in Louisiana or been under her jurisdiction...you know it's an
entirely different critter than what goes on in the rest of the country).
So precedence is in effect law...though it is more transient than codified
law in that precedence can change a lot easier than a codified law.  We do
also have codified law...but I am pointing out that precedence does bear the
same weight.

What Miranda did, was just reinforce the 4th and 5th amendments.  It didn't
create anything new.  It was just a safety measure to ensure that people
were aware of their rights when they get arrested.

I am of two minds about Miranda.  After all it's not even law, just court
precedent if I'm not mistaken (someone correct me if I am).

I would prefer they be read their rights though yes.
