I am not sure I would agree that we have territories that don't have full legal rights in regards to criminal actions. They may not have a seat in congress and stuff like that, but they have the full protection of the rights listed in the constitution when one of their people breaks the law or is accused of doing so. Their courts would operate in the same manner as any other court in the CONUS.

Even Jose Padilla, who was being illegally held as an enemy combatant, was eventually released to civilian authorities for prosecution.
