I am not sure I would agree that we have territories that don't have full
legal rights in regards to criminal actions.  They may not have a seat in
congress and stuff like that, but they have the full protection of the
rights listed in the constitution when one of their people breaks the law or
is accused of doing so.  Their courts would operate in the same manner as
any other court in the CONUS.

I was just pointing out a logical flaw in the statement not disagreeing with
your broader point.

U.S. citizens caught (by Americans and not someone else) in the US or abroad
should be tried as Americans in open court with full access to their
accusers.

Not ones that were either US citizens or captured in the US.  Even Jose
Padilla, who was being illegally held as an enemy combatant, was eventually
released to civilian authorities for prosecution.  Much of what the Bush
admin did in this regard was rules as unconstitutional by the courts.

If you were even remotely familiar with the constitution, you would realize
that all people under the jurisdiction of the US are subject to the rights
guaranteed by the constitution as well as the laws that govern the land.
