Here seems to be the problem.  I believe the definition of lying is 
unclear to some.

Tell me you aren't serious, Jerry.

 From Merriam-Webster:

lie

1: to make an untrue statement with intent to deceive
2: to create a false or misleading impression

If we can accuse him of #2, by your own admission, then we can accuse 
him of lying.  You are just quibbling over words.
