Interesting (and by that, I mean ludicrous) case in Portland involving a police run in. Basics of the case are that a dude was jaywalking as he tried to get to work in the morning. A police officer, for what ever reason, was having a bad day and flags the guy down and was pretty obviously upset. Asks the jaywalker for identification. Jaywalker asks why as he goes to pull it out. Officer isn't having any of that, grabs him, slams him down to the sidewalk, handcuffs him, tells him he is being arrested and takes him down to the precinct.
Jaywalker is now suing, claiming injury, distress and wrongful arrest in what (I think) most people would agree is a bit of an overreaction on the part of the officer to jaywalking. Now, the really interesting part is that the City is defending itself against the issue of wrongful arrest by saying that jaywalking is not an arrestable offense. It isn't even technically a crime, it is a violation. So the reasoning goes that if something is not an arrestable offense, obviously the jaywalker was not arrested, no matter what it looked like. Uh...what? http://www.oregonlive.com/portland/index.ssf/2013/07/portland_jaywalking_case_raise.html Definitely not something I get. At all.
