Actually if you have seen any of the interviews with Newdow he was
pissed that "In God we trust" was on US currency and he saw the Pledge
as a first step.

Neville: How long have you been contemplating this suit? 

Newdow: One day I was just looking at the coins (that) is what brought
this up. I saw "In God We Trust" on my coins. I said, "I don't trust in
God," what is this? And I recalled there was something in the
Constitution that said you're not allowed to do that and so I did some
research. And as soon as I did the research, I realized the law seemed
to be on my side and I filed the suit. It's a cool thing to do. Everyone
should try it. 

Neville: Thank you, Mr. Michael Newdow. 

He is using his daughter as his cause:

Newdow: My daughter is in the lawsuit because you need that for
standing. I brought this case because I am an atheist and this offends
me, and I have the right to bring up my daughter without God being
imposed into her life by her schoolteachers. So she did not come and say
she was ostracized.

SAN FRANCISCO -- A federal appeals court panel drew outrage from across
the political spectrum by ruling that it is
unconstitutuional for classrooms to recite the Pledge of Allegiance, but
the decision may not last for long.
Some legal scholars say the ruling will likely either be overturned by
the U.S. Supreme Court or reversed by the full
9th U.S. Circuit Court of Appeals.

"I would bet an awful lot on that," Harvard University scholar Laurence
Tribe said.

Wednesday's ruling was in response to an atheist's bid to keep his
second-grade daughter from being exposed to religion
in school. In a 2-1 decision in favor of Michael Newdow, the panel took
issue with the words "under God" in the pledge.
