In response to several questions concerning the reasons for Captain Mark Aguirre's relief of duty on Saturday, August 24, 2002, police officers presented voluntary sworn statements late Friday evening, August 23. In these statements officers alleged criminal misconduct regarding Captain Aguirre using his official authority to coerce and influence their statements relative to the ongoing investigation into the recent incidents on Westheimer. Based upon evidence that has been provided to the Internal Affairs Division at this initial stage of the investigation, Chief of Police C.O.Bradford has authorized the relief of duty of a total of 13 officers. The breakdown of ranks is as follows: 2 captains, 2 lieutenants and 9 sergeants. Typically, an officer is relieved of duty when an allegation of criminal or serious administrative misconduct is alleged and the department's preliminary investigation indicates that a particular officer may have been involved with that misconduct. An officer being relieved of duty is not a sign of guilt, but is done to protect the officer and citizens, as well as maintain the integrity of the investigation.
