Tim, But by extension then you'd also have to ban fingerprints, because it fits the exact same definitions you're using for DNA evidence. The constitutionality of fingerprinting been decided by the courts over and over again. You can be legitimately fingerprinted under very defined circumstances. I see no problem with doing the same for DNA evidence.
