Okay, so here's another thing that lawyers are good for. I asked my sister
(the patent attorney that specializes in biotech stuff) how someone can
patent a gene. Here's her response (wacked that it is):

the general rule is that you
can patent a purified form of the gene b/c it doesn't exist in purified form
in nature.
