On your first point: there's a good reason not to use the example of
"your child's death" as the basis for the punishment system.


Using emotional standards for public policy is not a good thing - its
how we get mobs, riots and lynching (often of the wrong people).  The
reason that the law exists is to create a dispassionate forum for
addressing crime when we, the citizens, find ourselves unable to
emotionally dissociate ourselves from the situations.


Your arguments center on allowing those in extremes states (of stress or
emotion) to make life-and-death decisions - in other words those very
states that most impair our decision making process.


It sounds a good in a perfect system of assignment of guilt, but we lack
that (and probably always will).  Personally I am for the death penalty,
in theory, but find our discovery and assignment of guilt processes to
be questionable.  I am thus willing to live with (on the societal level)
some mistakes - as long as those mistakes were the result of an honest,
dispassionate system's hunt for the truth.  Emotional mob justice is
generally neither.

Is it immoral to kill someone even if the person is a killer? Should the
punishment be more severe for multiple murders? Like a good stoning vs a

different", BullSh*t! the victim was someone's child.

What about rape? 1 rape gets you sodomized, 2 rapes gets you castrated,

more death? Ask the victim.

What about a petafile? Is it the same for rape, is that just?

We should send them all to another over populated prison so we can pay
for
their 3 hots and a cot while they learn how not to get caught.

We should rehabilitate them all.

So if the victim's family can't do the honors. Then the court can
appoint
the executioner. Shouldn't the family have the choice to do it. Oh!
Shouldn't the family be able to say no don't execute the killer? Well
know
it's a crime against society and a jury needs to decide. That brings us
back
to what is just. Is any killer worth more than there crime?

Rage crimes! Justifiable Hiomiside.

A, B, C and D are in a bar.

A came to Kill B and does so (Pre Meditated Murder)

C not knowing of A's intent Kills A immediately afterwards. (Rage Crime)

D Came with A and kills C for killing A.

What happens to D?

penalty. If they fail to throw the switch, pull the trigger or eject the
