But seriously, we also pay a surtax on all recordable media (recordable tapes, cdc's, dvd's) that is intended to be divyed up amongst producers of music and other copy-able stuff (yes that's the legal term, stuff). So, there is that justification there as well that we are already paying for these files.
What if you were to set up a business model similar to radio, where users download files from you, you also give advertising on that same stream and then pay the record companies accordingly? You don't actually play the songs, but just make them available for download. Does such a thing exist?
