thanks my problem was the CF was using the System Account and 
not an account that had permissions.

What OS? If your CF server is on windows is should look like.

<CFDIRECTORY ACTION="LIST" DIRECTORY= \\myserver\myfolder\">

You want to end your UNC paths with a  \  always so permissions 
propagate down the folders. Also make sure your CF Application Service

is logged on with an ID that has rights to the folder you are trying to

access.
