I beg to differ

you can layer stuff over flash.
in the <object> tag add:
 <param name="wmode" value="transparent">

in the embed tag add wmode="transparent"

<embed src="my.swf" quality="high"
pluginspage="http://www.macromedia.com/go/getflashplayer";
type="application/x-shockwave-flash" width="580" height="314"
wmode="transparent">

this will allow you to put layers above the flash
