Try this:
<CFSET xmltext =

<Cfcontent type="text/xml">
<?xml version="1.0"?>
<CFOUTPUT>#xmltext#</CFOUTPUT>
It uses CFCONTENT not CFHEADER, and also puts in the <?xml version="1.0"?>
into the text (which should be in there not just in the header).
