Just out of curiosity, can't any 3rd party offer such an agreement/contract? I can see how it would be a PITA to track down 1000+ developers to sue, but I don't see how this prevents some random company from taking the heat, so to speak, for whatever tech they're pushing, "open" or not. Or does it not work that way?
