This is ridiculous.  I haven't seen anybody using 10mbs Ethernet for years
now, and if they are, it sounds like they might have some old equipment.

You can go over your bandwidth limit whether you are using 10Mbps or
100mbps.   What the problem probably is local network noise.  10mbs isn't
very fast, and when that bandwidth is being taken up by other local servers
transferring files between each other (or your host doing backups), or just
in general traffic on the network (if they are using 10mbps equipment, they
are also probably using hubs instead of switches, etc).  If you remember how
Ethernet works with hubs, a host will transmit and then check for
collisions.  If a collision is found, it will wait a random amount of time
and try to transmit again.  With a lot hosts on the network, while running
at 10mbps, this can be a real problem.   

Personally, I would find a new host.  You can get some decent colo deals
with Host My Site, which we did a few months ago.  We have a bunch of
dedicated servers there already and are now adding some colo's to the mix.
So far, so good.
