You might not be allowed to use cfincludes in the 404 error handler - if the cfincluded file was not present it would call the 404 handler, which would call the 404 handler, which would call the 404 handler ...
Seems like this might be like cferror with type=request or type=validation - you can't use CFML in it because of the possibility of an infinite loop.
