Since its an INSERT is seems like this should not happen, I could see this happening with an UPDATE. In any case without reviewing your code you may want to CFLOCK the INSERT EMAIL process. If its a heavy usage site I would look further into why this is happening and code around it rather than using a CFLOCK.
