I think the question isn't whether or not you would get caught, but whether or not you have the integrity to abide by the NDA. There's also nothing stopping you from burning copies and selling them on eBay or from publishing a beta to a warez group or file sharing network. If someone doesn't plan on abiding by the agreement, they shouldn't make it.
