Ok, having gone through the custom tag (cfforward), and having played around with the 
encode types of forms... the issue lies in here somewhere... it is beyond me however..

According to the author of the custom tag, using a forward on the action page of a 
form will throw an error and does not work.

hmmm. interesting.
