Andrew - you're certainly not breaching any agreement whatsoever when you log a 
bug against CF 9 on the public bug tracker and pass on the feedback you get 
from the engineering team.

Note: this might be different if you WERE part of a private beta program 
because then you sign up to an NDA which might or might not restrict whatever 
you can share with people who are NOT in said private beta program.
