Steve, I don't know if this relevant but I had a look at the site and closed the popup window with the X in the top corner. If I hit a link on the page before the popup came up again I got the warning alert but the disclaimer window didn't reopen.

The site loads, the popup pops up and they hey to click either "accept" or "decline". if the user closes the popup, it reopens. if the user tries to click the main site while the popup is open, an alert pops up and tells them they need to accept the terms before using the site, and the popup gains focus again.
