OK, I did misunderstand what you were trying to say.

Our royalty licenses are NOT based on profit - they are a percentage of
turnover (or some other negotiated function of the size of the customers'
business - ideally a number that they are producing already and comfortably
to let us know). 

A function of profit doesn't work, customers can manipulate it too easily -
and as you point out, it may be when you are losing money that J is in fact
most valuable to you. That's when it is time to change something - QUICK!

My thought was more that even if you are losing money you can
usually find some alternative frame of reference where you have
saved 2%.

I did not mean to suggest the opposite -- sorry about that.
