Some dogs are actually happier outside. I have a husky/wolf mix outside. She is 
not confined, but just runs around the yard. It has been so cold that I have 
tried everything to get her to come in. Finally, the other night, I picked her 
up and carried her in. She hated it and the first time the door was open, she 
darted out. She is an outside dog by nature and flat out doesn't want in. She 
refuses a dog house as well....preferring to sleep under the house where no 
doubt she has torn insulation to bits, lol. 

My cats are the same for the most part. They will come and go. I let them in 
when they want in and let them out when they want out and they mostly prefer 
out...coming in only long enough to eat all the chi's food, lol

  being fed and given water, there's not anything illegal about the 
  situation in most states. It's a horrible reality. 

  I would do what someone else suggested and go talk to the neighbor and 
  see if he can't please, please bring the dog in during cold weather. 
  Even if you do contact the Humane Society or something and they send an 
  animal control officer out, they probably won't be able to take the dog 
  unless he is starving or mistreated physically. Huskies are bred to 
  live outside in the snow and ice so I don't think he can freeze to 
  death. But, to me and most people, it's very cruel to leave a poor dog 
  tied out all alone with nothing to do and no one to be with. I really 
  wish they would change the laws against tying a dog out. I think all 
  dogs belong inside with their families! But, unfortunatley, it's not 
  the reality and it happens a lot, everywhere. :(
