CopyTreeWorkItemTest.NewNameAndCopyTest fails sometimes

This test is trying to test that 1) we successfully copy a file with
alternate name
when destination files is in use and 2) we overwrite the destination file
when it is
not in use. We test the first case by launching a process to mark the file
in use.
Later we terminate the process, cleanup the handles and try to test the
second case.
It seems occasionally even though the process has been terminated, the file
remains
marked as in use and the test fails.
This happens very rarely but I am not sure why it happens. I haven't found
any
instance of this on current buildbot going back 3-4 pages.
