my opinion is that the behavior doesn't make any sense, even if it does act  
like Safari in
this regard. I'd say Safari's behavior is a bug.

to a user, whether or not they've focused a window once is irrelevant, it  
just appears to
behave differently some of the time. the front-most window should be  
the "focused"
window for the app even if the user hasn't physically clicked on it yet.
