The way the init script is set up for debian relies on you having Foreground specified in clamd.conf, and having daemon installed. Is that the case? It certainly seems to work when I test it, and I have had no bug reports about it since I set it up, so I am assuming it works for most people doing it. Are you using the init scripts supplied with the package?
