Are you using clamav-milter with or without clamd?

If you are using it with clamd then you should add (uncomment really)
NotifyClamd in your freshclam.conf .  This may only solve the problem if clamd
has been running a long time but not refreshing the database (since freshclam is
not telling it to do it).
