In general, this hasn't been a problem for me, and I am on quite a few mailing lists. Most of the MLM's out there have some logic for this, so if you accept most messages sent from the list, you stay on without probes. If someone's MLM doesn't do this, I would suggest hacking on the MLM to have this sort of logic. The problem with your approach is that it means every MTA everywhere needs to do the same thing consistently - this will never happen. Many MTA's still don't support ESMTP. Better to change it in one place, and simpler.
