Are you depending on syslog to write to the log? If so, did you configure
syslog to accept input from ClamAV, and did you configure ClamAV to use
syslog?
If ClamAV is to write directly to the log file then the log file probably
needs to be owned and writable by the ClamAV run-as user, and the parent
directory permissions need also to allow this.

think i have found the reason
looks like clamav created the file but in clamd.conf i have
LogFile /var/log/clamav/clamd.log
which is updating. could be clamd.log is a legacy setting or maybe i should
change clamd.log to clamav.log
