I was unaware that the creation of Java clones was forbidden in the
past, but this quote seems to indicate that it has been:

"At Java Business Expo in New York, Sun will roll out dramatic revisions
to its Java licensing and development model, sources familiar with Sun's
plans said last week.
"First, it will bless the creation of compatible Java clones. Second, it
will permit Java licensees to retain ownership of advances they make to Java
instead of having to turn those enhancements over to all Java licensees.
Third, Sun will open up the working group process to all comers, not just
licensees."

Also, good news on IBM from that same article: "IBM will announce this
week plans to move its Jikes Java byte code generator to an open-source
model."

It remains to be seen just how good that news actually is.
