The press is taking the obvious meaning of "open source" -- that is,
"you can get the source code."

Java 2 is clearly not free software. From Sun's press release:
For commercial entities that modify the source code and create
derivative products for either production use within their
organizations or for commercial distribution, or for service
organizations that use the source code as the basis for a
commercial support or consulting contract, Sun will continue to
charge fees.
