It can be.  However, GNU has to be careful about obeying intellectual
property laws, and they take advice from their legal counsel, so yes,
they require a signature (of some form) for all code included in the
main distribution tree.  They need to have legal permission to use the
code.

In the case of SableUtil, they'd just sign a small piece of paper
which essentially says "yes, the FSF can distribute this code under
their normal distribution terms".
