Good point, though in my world, if AD fails - its not my headache as I have 
fallback for auth (I'm  on the linux side of the house).

No the 4.1 and beyond have this issue resolved, the only change that needs to 
be done is to alter auth mechanism in one of the XML files. Restart and run the 
config of ldap  and that should be it.
