Do everything you are supposed to do to resolve the problem (it's called 
due diligence).  Document your steps if you are really worried.

If things ever went to court and you can show that you have done your 
due diligence, it'd be hard to hold you accountable.

As for what you could be doing, change your passwords, check your log 
files, lock out suspect IPs, etc.

The threat of legal tactics for port scanning is just that, a threat.  I 
doubt it would hold up in court.  Afterall, I can walk down the street 
and take note of all the open windows in the houses near by.  That's 
essentially the same as port scanning, and is not illegal.

But of course, where the law is concerned, you'd be better talking to a 
lawyer.  To the best of my knowledge there are no lawyers on the list 
though...
