Linspire has very severe limitations on copying and distribution, i am not
sure, but it would be in breach of the gpl, regardless of any deal they would
have made with Microsoft. And having a freespire, opeSUSE etc is a slap in
the face of the free software / Open source movement as a whole. The main
idea being Open source / Free software is not a free and lesser variant of a
bigger, un-free chunk of software, it took about 8 years of strong advocating
and hard work form the community to disassociate itself and its truly free
full value (product) from the cripple ware and demo ware that was more
associated with the abuse of the word "free" only to be desecrated by the
likes of Linspire and SuSe ...
Cheers

Ps.: I do remember when SuSe, before Novell, was , as a distro, non-free. But
the only limitation there was that you could not sell SuSe disks, hardly a
problem, for LUGS and normal people. When Novell bought SuSe, with all the
stare that caused, they actually GPLed SuSe ... just a historic note. When I
Say SuSe here i mean the installer and the package manager (yast) and the
good bunch of software that glues the distro together, and not it's otherwise
OSS or GPL package content.
