I had never thought it made much difference, but this came up today:  7 days of respiratory therapy with excellent documentation for 322 minutes.  Rug score was SSA.  I redid with no minutes RUG score was CB1.  This was a resident that had been discontinued from medicare and I was calculating an OMRA for DEMAND billing.  Do I reinstate medicare??? The Dept of public health stated my minutes and documentation of them were correct.  However I called my FI and because the respiratory status was stabilized and did not require MD intervention she would not be a candidate for Medicare.  I documented everything and attached it to the MDS in anticipation of the DEMAND bill, I left in the respiratory minutes on the MDS and left her as an SSA. 
What would you have done?
 
I am in Massachusetts and the state has determined that they will require demand billing to medicare for anyone who is given a denial letter before their 100 th day.  As a matter of fact we received notice today of demand billing dating back to care provided 11-02, 12-02 and 1-03 through June 03.
