We have a Medicare resident that went LOA at 10P and returned at 2A. We are considering the day as a non-billable day and moving the PPS schedule one day forward per the midnight rule. The question we have is regarding the medications taken on the day he went LOA. Are we responsible for those also; do we bill him privately; do we bill medicaid? Unfortunately this is a situation where we are losing money anyway since his medications cost $800 a day.
