Does it not say that the patient must be in the upper 26 Rugs and would be skilled 
thru and including the ard date?I had almost the same scenario with a new admit 
yesterday.Patient with lung ca and brain mets.Comes to us from acute rehab where she 
has been for 3-4 weeks after resection of brain tumor.I can not get her into any of 
the top 26and no rehab needed.I felt a denial should be issued on admission.I will 
follow next 30 days to see if she becomes unstable that I could look for a complex Rug 
category.We weren't admitting from acute care so I didn't feel obs and assess was 
appropriate.Nedless to say admissions not happy with my decision.
