Medicare does not have a bed hold policy or provision.  Medicaid bed hold provisions are state specific and usually found in each state's Medicaid state plan, regulations or provider manuals.  Usually, if a charge is made to hold a bed during hospitalization or therapeutic leave that exceeds the Medicaid bed hold period if one is authorized in the state, it is for a specific bed not any empty bed that is available upon readmission.  Federal regulations do provide for a priority readmission right to Medicaid residents if their hospital stay exceeds the state bed hold provision.  If the resident still needs nursing facility level of care, they have the right to the first available semi-private bed when they are ready to return to the facility.  42 CFR 483.12(b).

Marie, what are the regulations concerning bed holds & medicare/medicaid. Specifically, can you charge to ensure a bed will be available (not necessarily the one the resident was in) & fill the beds with other residents knowing that other beds will be available d/t discharges pending? Thanks
