The definition of Resists care on page 3-66 of the manual states, "This category does 
not include instances where the resident has made an informed choice not to follow a 
course of care (e.g., resident exercised his or her right to refuse treatment, and 
reacts negatively as staff try to reinstitute treatment.)"

So, a resident may make an informed choice not to accept care and not be resisting 
care.  The important phrase here is INFORMED.  Have your staff informed the resident 
of the risks and benefits of the treatment?  Has the resident voiced why he/she does 
not want the treatment?  Are there alternatives that the resident will accept?  Are 
there barriers to his/her understanding of the reason for the treatment plan?  Is all 
this documented and on the care plan?

Good morning Group,
I resident that is alert and oriented X3. Refused meds, ordered treatments. We got 
sited because the MDS did not code for resisting care. It is the SS impression that he 
is simply stating his right to refuse. I remember reading something last week from the 
group about this. 

Can someone give me a source to back up failing to code resisting of care due to right 
to choose. Thanks.
