Does the side rail restrict movement and prevent the person from coming and going freely?  The question of ability is secondary to desire in determining if the side rail meets the definition of a restraint.  A side rail used for âSafetyâ to prevent the person from getting out of bed qualifies as a restraint. 
Any chance you could inservice California surveyors? They so don't get this very important point!!
