I'm not a pro & hopefully someone else will help, but I would consider he had used his 5 days presumed coverage while in swing bed unit.  However, if there is something else, like therapy to skill him, you could probably pick him up for skilled care but I think you would have to count the days in swing bed as the first days of benefit period.

Subject: skilled or not??

We recently admitted a resident from a hospital based swing bed.  He was originally hospitalized for UTI sepsis with confusion and weakness.  He was discharged from therapies due to lack of progress, thus dc'd from swing bed. Is it appropriate to use the baseline 5 day observation period to skill him now that he is with us in LTC or would those 5 days have been utilized by the hospital swing bed?  Any assistance is greatly appreciated.
