Also--don't forget--Medicaid is the payor of last resort. So a
family/resident can really not "waive" the Medicare benefit. Public aid
(Medicaid/Medi-cal, etc) will NOT pay if the MC benefits COULD have been used,
and weren't.

Subject: waive medicare rights if on public aid I have a lady who had never used her 100 days for feeding tube as when it was placed she was still on po diet and feedings were supplemental and did not meet skilled requirements. Now she has been hospitalized for 3 day and in a Medicare bed with IV fluids/meds. Can she use her 100 days now for her feeding tube?
