To quote a friend of mine:

"A funny thing about the America's Cup. It isn't owned by anyone. The deed
is entrusted and the terms of the deed are enforced by the courts in New
York State. As a result, the AC is precisely and exactly what Mr. Jewett
wanted it to be when he wrote it. While all of us may argue various
strategies about what would make the cup "better" in our various opinions,
none of them matter one wit. The Deed says exactly what the Cup will be.

The interesting thing is that the deed is such a simple document and has
worked so well for so long. We've had numerous lawsuits, and nearly had
some fist fights, but in the end over 162 years the deed and guided the Cup
through match after match.

The formula is so simple.

1) If you can get agreement between challenger and defender, then you can
do whatever you want. If you can't it's a DoG match.
2) See #1 above.

I think this has worked rather well for a long time."
