Seeing as Xcode 3.1 is under NDA (as far as I can tell) I hope Apple doesn't take it on Aaron for using it. His book is the best thing there is for bringing newbies into Cocoa (and Aaron himself is a treasure) and it would be petty to start a ruckus on that.
I doubt Aaron forgot to get that cleared before the release. They've given similar permissions to other people.
