I think the Finder only knows that because it's the one doing the copying. If something else is copying a file (like the 'cp' command) the Finder doesn't gray out the file.
Unix doesn't really have a notion of a file being "busy", except via higher level mechanisms like exclusive locks. In general, I think it's difficult to figure out if some other process has opened a file. The 'lsof' tool does it, but I think it uses privileged system calls.
