Yes. (Unless you're distributing through the Mac App Store.)

Why? "MyApp_CrashReporter" shouldn't raise any red flags, especially if you 
give the user the *decision* as to whether to allow this or not--and if you 
don't, it really is spyware anyway--mild spyware, for an innocuous purpose, but 
regardless, sending yourself information about your user's activity without 
your user's permission is exactly that.
