The current Cocoon-Serializer Implementation is not dependent on Xalan, but uses the Trax-API (part of the JAXP API) - so it can be used with other implementations like Saxon etc. as well without any problems. So your fix will tie the implementation to Xalan. The better solution will be to fix Xalan and help the Xalan team to get this bug solved.
