what legal recourse does apache (host of the cocoon project and implementor of the apache license) have over these guys. I mean is cocoon copyrighted and/or any of the proprietary concepts, e.g. XSP, etc.

The copyright is covered by tbe license:

http://xml.apache.org/cocoon/license.html

In short, a piece of software that includes Cocoon code only needs to include the above license and mention that it contains code from the Apache Software Foundation. In addition, you can't use the name Apache Cocoon without specific agreeement. Period. They don't have to mention it on their Web site or anything. The Apache licence gives a lot of freedom to commercial uses, unlike for example, the GPL.

The use of the term XSP may be a mistake or just ignorance. Outside the Cocoon world, unfortunately, pretty much nobody has heard of XSP.
