No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
 
Comment: Anyone born or naturalized in the United States is a citizen. All citizens are entitled to due process (basic fairness), according to the Constitution and Bill of Rights. Laws must be enacted and enforced in a way that treats people equally.

Mi comentario es:
 
El "bill" propuesto por el Sr. Stump, (seg�n nos cuenta PANGsaurius), en realidad NO propone un cambio constitucional. Lo que trata de hacer, de manera equivocada a mi modo de ver, es aseverar que seg�n la 14a. enmienda, el Congreso tiene la potestad de definir qui�n es y qui�n no es ciudadano de los Estados Unidos, y bas�ndose en eso, segregar a los hijos de madres no residentes de manera permanente en los Estados Unidos.
 
El art�culo 5 de la 14a. enmienda de la Constituci�n no dice eso. Solo le da al Congreso la tarea de, mediante adecuada legislaci�n, poner en ejecucion ("enforce") lo previsto en la enmienda. No de cambiarlo, sino de ponerlo en ejecuci�n, y teniendo en cuenta que la secci�n 1 dice de manera inequ�voca "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside", el Congreso no puede mediante un simple "bill" (o una simple ley), cambiar esa clara e inequ�voca estipulaci�n constitucional. Dicho de otro modo, el "bill" propuesto trata de "clarificar" algo que no requiere ninguna clarificaci�n, y mediante un mecanismo que no es el autorizado constitucionalmente.
 
Para producir el efecto deseado, el se�or Stump (?!) tendr�a que proponer un cambio constitucional, asunto m�s espinoso y complejo.
 
Claro, todos estos asuntos tienen mucho de ancho y de largo. En todo caso, a riesgo de aparecer por en�sima vez como intelectualmente sin fruto, creo que si una ley como esta pasara o fuera aprobada en el Congreso, ser�a muy vulnerable, y posiblemente tumbada muy pronto, por inconstitucional.
